Privacy and You

Gough & Gilmour Holding Pty Ltd ("Gough & Gilmour") aims to provide you with a superior service which enables you to achieve the lowest cost of operation for your earthmoving machinery. In order to do this, we need to collect and hold some information about you, and some information about the machinery that you have purchased. To the extent that the information we collect is "personal information", we have committed to use that information according to the National Privacy Principles ("NPPs") which are contained in the Privacy Act 1988. "Personal information" is basically information or an opinion that can identify you as an individual. Note that information that can identify other entities (eg companies) is not "personal information" (as it does not identify an individual person), and so is not regulated by the NPPs.

Collection of Personal Information and Other Information

We collect personal information and other information to:

provide for the sales and servicing of our earthmoving machinery, and
meet our ongoing contractual and statutory obligations to you and others (for example, in relation to warranties and product safety).

We may also use personal information to provide you with information and advice about products and services that may be of interest to you on an ongoing basis. However, as explained below, you can tell us if you don't want us to use personal information about you in this way.

The personal information and other information we collect may include your name and address details, details of the machinery you have purchased from us and the use to which it is put, information about the servicing of your machinery and the parts you have purchased (whether we have serviced your machinery or not). If you have a credit facility with us, we may also collect some financial information about you.

Generally, we collect most of this information directly from you (for example, when we sell you a machine, when we service your equipment or when you order parts from us). In the past (and prior to the commencement of the NPPs), we may have collected a small amount of information about you from third parties. Our current policy is to collect personal information about you from third parties only where you have given your consent to such collection.

Use and Disclosure of Personal Information and Other Information
Unless you tell us otherwise, we may use personal information about you to provide you with information about new products and services and promotional or educational events which may be of interest to you as an owner of earthmoving equipment. If you do not wish to receive promotional or educational information from us, please fill in the coupon below and return it to the address on the coupon.

For the purposes of organising customer mail outs, product launches and promotions, field days and customer evenings, we may also pass on personal information to third party contractors (eg mailing houses, professional function organisers). We may also pass on personal information and other information about you to third party contractors who provide technology services to us (eg suppliers of information technology support and email services).

We require all third party contractors who handle personal information (in the course of providing services to us) to comply with the NPPs and to use that information only for the purposes of providing specified services to us. We do not permit our third party contractors to use or disclose personal information about you for any other purpose.

Unless required by law or permitted under the Privacy Act, we will not disclose your information to another organisation other than as disclosed in our privacy policy without your prior consent.

Storage and Security of Personal Information

We take steps to ensure the security of your personal information from such risks as unauthorised access, loss or misuse. This includes ensuring that our staff understand that they must protect your privacy.

Accuracy of Personal Information

In order to keep your personal information as current as possible, we ask that you let us know of any changes to your contact details by telephoning us or filling out the coupon below.

Access to and Correction of Personal Information

Under the NPPs, you have the right to request access to the personal information which we hold about you (although there are some exceptions to this). You also have the right to ask us to update or correct personal information about you if it is inaccurate or out of date. As noted above, we are keen to keep your personal information as current as possible.

If you want to access your personal information or to update or correct personal information, you can fill out the coupon, write to us or phone us on 02 9840 9269 and ask for our Privacy Co-ordinator. If your request requires a great deal of work to process, we may charge you a fee, but you will be advised of the fee in advance.

Online Privacy

To the extent that this privacy policy applies to online privacy issues, it is to be read as forming part of the terms of use for our website.

Generally, we will handle personal information collected online consistently with the way that we handle personal information offline.

Our website uses cookies. If you do not wish to receive any cookies you may set your browser to either prompt or refuse cookies. We use cookies for tracking website statistics, and to better understand how our website is used. However, please note that while cookies will identify your computer, they should not be able to identify you.
